Terms and Conditions for the supply of goods 

DEFINITIONS 
In these terms and conditions "Company" means Norbury Wharf Limited. "Buyer" means the customer who places an order and to whom the Company agrees to supply goods. 
"Goods" means any product or services supplied by the Company. 
"Price" means the price on this website. 
 
PAYMENT AND TITLE 
The Company reserves the right to require payment prior to delivery unless the Buyer has an account with the Company. 
Where the Company has agreed to supply the goods on credit, payment is due no later than 30 days from the date of the invoice. 
If payment under these conditions is not made when due an interest charge will be made on overdue payments from the original due date until payment actually takes place at the rate of 5% per month. 
The property in the Goods shall not pass to the Buyer until paid for in full, including VAT, interest on late payment and any other sums due from the Buyer to the Company. 
Until such time as the legal and beneficial ownership of the Goods passes to the Buyer the Company shall be entitled at any time to require the Buyer to deliver up the Goods to the Company and if the Buyer fails to do so forthwith, the Buyer hereby authorises the Company to enter upon any premises of the Buyer or any third part where the Goods are stored and to repossess the Goods. 
If the Buyer makes a voluntary arrangement with its creditors or being an individual or firm becomes bankrupt or being a company becomes subject to an administration order or goes into liquidation or if a receiver is appointed over any of the Buyers assets or the Buyer is unable to pay its debts as they fall due then, without limiting any other remedy, the Company may at its discretion suspend further deliveries or canal contracts for the Goods. 
 
PASSING OF RISK 
The Goods shall be at the Buyers risk as from delivery. 
 
CARRIAGE AND DELIVERY 
Goods should be inspected upon receipt and all shortages or damages must be notified to the Company within 24 hours of receipt. 
Delivery charges on Goods supplied from the online catalogue will be calculated by the shopping cart total. 
Any goods supplied in accordance with the Buyers orders but which are subsequently returned will only be credited provided the Company agree in writing in advance. 
All returns including packaging should be in perfect condition. 
All returns will be credited subject to a 10% handling charge. 
The cost of returning goods is at the Buyers expense. 
 
DEFECTIVE PRODUCTS 
All Goods are sold with manufacturers warranty unless specified otherwise. 
Defective goods should be returned to the Company at the Buyers expense, along with the original packaging and a copy of the original invoice or receipt. The Company may replace, repair or issue a credit note at its own discretion. 
 
FORCE MAJEURE 
The Company reserves the right to canal, suspend or vary the operation of contract of sale if events occur which are in the nature of force majeure including (but not limited to) fire, flood, storms, strikes, lock outs, riot, hostilities or any other event outside the control of the Company. 
The Company shall not be held liable for any breach of contract resulting from such an event. 
 
LEGAL CONSTRUCTION 
These terms and conditions are subject to the law of England and Wales. These terms and conditions shall apply to all contracts for the sale of Goods by the Company to the Buyer to the exclusion of all other terms and conditions. Any variation to these Conditions shall be inapplicable unless agreed in writing by the Company. 
 
POSTAGE & DISPATCH 
Please note that the postage charges refer not just to the cost displayed on the label but also to costs of labour and materials. 
If you are not happy with the fees please do not hesitate to contact our office, especially if you are ordering multiple items. Usually we can combine the postage on larger orders to make delivery cheaper. 
Dispatch times refer to how quickly we package and post the items from our shop. This is normally between 1 to 3 days depending on stock, weekends and bank holidays. 
We have no control over postage at particularly busy times of year or when there are adverse weather conditions. 
Certain size items or those that are particularly heavy cannot be posted with MyHermes and are sent via another courier. 
Small and lighter items are generally posted with MyHermes unless customer requests faster delivery. 
Any loss or damage to the goods is to be reported within 24 hours after receipt. 
Norbury Wharf Limited will not be liable for shortages or defects that are not reported within 24 hours following the receipt of goods. 
 
RETURNS 
All items may be returned to us providing the item is in its original condition and packaging. 
Returns must be notified within 7 days of receipt of goods. 
Return postage costs will not be covered by Norbury Wharf Limited unless goods are faulty or damaged.

REFUNDS 
Refunds for goods returned will be processed once goods have been received. 
Your invoice or a covering letter should be enclosed with the parcel to identify your order and refund accordingly.
